Terms of Use · Codex Whip

1. Acceptance of These Terms
By downloading, installing, or using the Codex Whip Mac app (“Codex Whip”), provided by Turushan Aktay (“we”, “our”, or “us”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, do not use Codex Whip.
2. Open-Source License
Codex Whip is open-source software under the MIT License. The license, not these Terms, governs your rights to use, copy, modify and distribute the software, and its source code is published on GitHub. These Terms cover the builds we publish and this website.
3. What Codex Whip Does
Codex Whip watches the Codex CLI sessions on your Mac. When a session stops at a capacity error, it waits the retry interval and asks the same session to continue with the same model, using your saved retry message. When a session stops at a usage limit, it waits until Codex reports that usage is available for the same account, then does the same. It never switches models, spends reset credits or changes accounts.
4. Your Responsibility
You choose which sessions run, how often Codex Whip retries and what message it sends. Codex’s own terms and OpenAI’s usage policies apply to everything Codex does, including work in a session that Codex Whip continued. Keep an eye on long-running work, because a retry can run tasks you started earlier.
5. Privacy
Your privacy is important. Please read our Privacy Policy to understand how we collect, use, and protect your data. It forms part of these Terms.
6. Disclaimers
Codex Whip is provided “as is” and “as available”. We do not guarantee that a retry succeeds, that a model has capacity, or that quota becomes available at a given time. Codex Whip is unofficial: OpenAI does not make, endorse or support it. Features may change. Nothing in these Terms limits rights you have under mandatory consumer law.
7. Limitation of Liability
To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, including damages from a retry that was or was not sent, or from what Codex does in a session that continued, and our total liability is limited to the amount you paid for Codex Whip in the 12 months before the claim. This does not limit liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of Germany. You agree to resolve any disputes through the courts of Hamburg, Germany, unless local consumer protection laws offer you additional rights.
9. Changes to the Terms
We may update these Terms. We will announce significant changes on this page or in the app before they take effect, and update the date above.
10. Miscellaneous
These Terms, the Privacy Policy and the open-source license form the entire agreement between you and us. If any part is found invalid, the rest remains enforceable. You may not transfer these Terms without our permission.
